By accessing, using, or purchasing from Image Color Picker, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these terms, you must not use our service or make any purchases.

By accessing and using Image Color Picker, creating an account, or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. This agreement is effective as of your first use of the service or completion of a purchase, whichever occurs first.

We reserve the right to update or modify these terms at any time. When we make material changes, we will update the "Last updated" date and may notify you through the service. Your continued use of the service or any purchases made after such changes indicates your acceptance of the updated terms. It is your responsibility to review these Terms periodically.

Description of Service

Image Color Picker provides both free and paid features. Our free features include:

• Extract color codes from images in various formats (HEX, RGB, HSL, CMYK)
• Generate color palettes from uploaded or linked images
• Explore color variations, shades, tints, and harmonies
• Use an interactive color picker to select and customize colors
• Copy individual color codes to clipboard
• Open palettes in external tools (e.g., Coolors)

The service processes images locally in your browser when possible. For URL-based images, our server acts as a proxy to fetch images due to browser security restrictions.

Paid Services and Digital Products

In addition to our free features, Image Color Picker offers premium paid features:

Single Palette Export

A one-time purchase that allows you to download a complete palette bundle for a single color palette. This includes digital files in multiple formats (PNG, SVG, JSON, CSS, SwiftUI, Android Compose, Android XML, Flutter). The current price is $1.99 USD per palette export.

Lifetime Access

A one-time purchase that grants you unlimited palette exports for the lifetime of your account. This requires creating and maintaining an account with us. The current price is $5.99 USD.

Nature of Digital Products

All paid products are digital goods delivered electronically. Upon successful payment, you will receive immediate access to download your purchased content. No physical products are shipped. Digital files are provided "as-is" at the time of purchase.

Delivery

Digital products are delivered immediately upon successful payment processing. For single exports, you will be redirected to download your files automatically. For lifetime access, your account will be upgraded immediately and you can access unlimited exports. If you experience any delivery issues, please contact us within 48 hours of purchase.

Pricing and Payment Terms

All prices are displayed in United States Dollars (USD) and are inclusive of applicable taxes unless otherwise stated. We reserve the right to change our prices at any time without prior notice. Price changes will not affect purchases already completed.

Payment Processing

All payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service and privacy policy. We do not store your full credit card information on our servers. All payment data is handled directly by Stripe in compliance with PCI-DSS standards.

Payment Methods

We accept major credit and debit cards as supported by Stripe, including Visa, Mastercard, American Express, and others. Additional payment methods may be available depending on your location and Stripe's supported options.

Authorization

By providing payment information and completing a purchase, you represent and warrant that: (a) you are authorized to use the payment method provided; (b) the payment information you provide is accurate and complete; (c) you are at least 18 years of age or the age of majority in your jurisdiction; and (d) you authorize us to charge the payment method for the total amount of your purchase.

Failed Payments

If a payment fails or is declined, you will not receive the purchased digital products. We are not responsible for any fees charged by your bank or payment provider for declined transactions. You may attempt the purchase again with a valid payment method.

Currency and Taxes

All transactions are processed in USD. If your payment method is in a different currency, your bank or card issuer may apply currency conversion fees. You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.

Refund and Cancellation Policy

ALL SALES ARE FINAL. Due to the nature of digital products, which are delivered immediately and can be downloaded instantly upon purchase, we do not offer refunds under any circumstances. By completing a purchase, you acknowledge and agree to this no-refund policy.

Why No Refunds

Digital products cannot be "returned" once delivered. Upon successful payment, you receive immediate access to download your files. Because there is no way to verify whether files have been downloaded, used, or copied, we cannot offer refunds.

Before You Purchase

We encourage you to:

• Review the preview of what you will receive before purchasing
• Ensure your color palette is complete and satisfactory using our free features
• Verify you understand what file formats are included
• Confirm you have a valid payment method

Duplicate Charges

If you are charged multiple times for the same purchase due to a technical error, please contact us with your transaction details. We will investigate and refund any verified duplicate charges.

Chargebacks and Disputes

If you initiate a chargeback or payment dispute with your bank or credit card company, we reserve the right to: (a) terminate your account and permanently revoke access to any purchased content; (b) contest the chargeback with full documentation including download records; (c) recover any costs and fees associated with the dispute; (d) refuse all future service; and (e) report fraudulent chargebacks to relevant authorities. Chargebacks for legitimately delivered digital products constitute fraud.

If you experience technical issues accessing your purchased content, please contact us and we will work to resolve the issue. Technical support does not entitle you to a refund.

Account Terms and Requirements

Account Creation

Certain features, including Lifetime Access purchases, require you to create and maintain an account. You may create an account using supported authentication providers (Google, GitHub). By creating an account, you agree to provide accurate and complete information.

Account Security

You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account.

Account Linked Purchases

Lifetime Access purchases are permanently linked to your account at the time of purchase. Access cannot be transferred to another account. If you lose access to your account or delete it, you will lose access to your Lifetime Access benefits, and no refund will be provided.

Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, you will lose access to any purchased content associated with your account. For accounts terminated due to Terms violations, no refund will be provided.

Account Deletion

You may delete your account at any time. Upon deletion, all data associated with your account, including purchase history and access to Lifetime Access benefits, will be permanently removed. This action is irreversible and no refunds will be provided for unused Lifetime Access.

License Grant for Purchased Content

Upon successful purchase and payment, we grant you a limited, non-exclusive, non-transferable, worldwide license to use the purchased digital files subject to the following terms:

Permitted Uses

• Use the color palette files in personal and commercial projects
• Incorporate the colors and code into websites, applications, designs, and other creative works
• Modify the files for your own use
• Use the files in client projects and work-for-hire

Prohibited Uses

• Resell, redistribute, or share the downloaded files as standalone products
• Include the files in products intended for resale where the files are the primary value
• Claim ownership of the original file formats or generation method
• Use the files in any illegal or unlawful manner
• Share account access or transfer Lifetime Access to another person

License Duration

The license granted is perpetual for files you have downloaded. However, your ability to generate new exports (for Lifetime Access) depends on the continued operation of our service and your account remaining in good standing.

Permitted Use

You may use Image Color Picker for both personal and commercial purposes, subject to these terms. Permitted uses include:

• Extracting colors from images you own or have permission to use
• Using extracted colors in your design, development, or creative projects
• Sharing our tool with others
• Embedding or linking to our service (with proper attribution)
• Purchasing and using paid features in accordance with the license terms
• Creating an account to access premium features

You agree to use the service only for lawful purposes and in accordance with these terms.

Prohibited Use

You agree not to use Image Color Picker to:

• Process images that contain illegal content
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Attempt to disrupt, damage, or gain unauthorized access to our servers or systems
• Use automated systems or bots to access the service in a manner that exceeds reasonable usage
• Distribute malware or other harmful content through our service
• Circumvent, disable, or otherwise interfere with payment or access control features
• Use stolen or fraudulent payment information
• Create multiple accounts to abuse free features or circumvent purchase requirements

• Use the service to compete with us or create a similar service

We reserve the right to refuse service, terminate accounts, and revoke access to purchased content for anyone who violates these terms, without refund.

Intellectual Property

Your Content

You retain full ownership of all images you process using Image Color Picker. We do not claim any rights to your images, the colors extracted, or any palettes generated. You represent and warrant that you have all necessary rights to any images you upload or process.

Our Content

The Image Color Picker website, including its design, code, features, user interface, algorithms, and content, is protected by copyright, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our service without explicit written permission.

Purchased Digital Files

Upon purchase, you receive a license to use the generated palette files as described in the License Grant section. The files themselves and the format/structure are provided for your use, but the underlying service, generation methods, and technology remain our intellectual property.

Open Source Components

Some portions of our service may use open-source software. These components are subject to their respective licenses. Our use of open-source components does not grant you any rights to our proprietary code or features.

Disclaimer of Warranties

IMAGE COLOR PICKER, INCLUDING ALL FREE AND PAID FEATURES, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of color extraction results
• Warranties that the service will meet your specific requirements
• Warranties that digital files will be compatible with all software or systems
• Warranties regarding the accuracy of color representation across different displays or print media
• Warranties that the service or purchased features will be available indefinitely
• Warranties regarding the security or availability of payment processing

Color accuracy may vary depending on image quality, your display settings, color profiles, and other factors. We recommend verifying critical colors through additional means when precision is essential. Digital files are provided as-is and may require adjustments for your specific use case.

WE EXPRESSLY DISCLAIM ANY WARRANTIES REGARDING THE SUITABILITY OF PURCHASED DIGITAL FILES FOR ANY PARTICULAR PROJECT, CLIENT, OR USE CASE. YOU ACKNOWLEDGE THAT YOU HAVE EVALUATED THE SERVICE AND SAMPLE PREVIEWS BEFORE PURCHASE AND ACCEPT THE PRODUCTS IN THEIR CURRENT FORM.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IMAGE COLOR PICKER, ITS OPERATORS, OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, special, consequential, exemplary, or punitive damages
• Loss of profits, revenue, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the service
• Damages resulting from any content or colors obtained through the service
• Damages arising from unauthorized access to or alteration of your transmissions or data
• Damages resulting from payment processing issues, including failed transactions or incorrect charges
• Damages arising from loss of access to purchased content due to account termination or service discontinuation
• Damages resulting from the incompatibility of purchased files with your software or systems
• Any damages arising from third-party services, including payment processors
• Damages resulting from errors in pricing or service descriptions

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE OR PURCHASING PRODUCTS DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS LESS.

This limitation applies regardless of the legal theory under which damages are sought, whether in contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Image Color Picker, its operators, owners, employees, agents, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees and legal costs) arising from:

• Your use of the service, including any purchases made
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property rights
• Any content you process through the service
• Your use of purchased digital files in violation of the license terms
• Any fraudulent, abusive, or illegal activity related to your account or payment methods
• Any chargeback or payment dispute initiated by you that is found to be unwarranted
• Any claim that your use of our service or purchased content caused damage to a third party

This indemnification obligation will survive the termination of these Terms and your use of the service.

Third-Party Services

Our service relies on and may interact with third-party services such as:

• Stripe (payment processing) - handles all payment transactions and stores payment information
• Firebase/Google (authentication) - provides account authentication services
• GitHub (authentication) - provides account authentication services
• Vercel (hosting provider) - hosts our website and services
• Umami Analytics (privacy-focused analytics) - collects anonymized usage data
• External image URLs you provide

By using our paid features, you agree to the terms of service and privacy policies of Stripe (stripe.com/legal). Payment processing is entirely handled by Stripe, and we do not have access to your full payment card details.

We are not responsible for the content, privacy practices, terms, availability, or actions of any third-party services. Your use of third-party services is governed by their respective terms and is at your own risk. We are not liable for any damages or losses caused by third-party services, including payment processing errors or authentication failures.

Service Availability and Modifications

We strive to keep Image Color Picker available and functioning properly, but we do not guarantee:

• Continuous, uninterrupted access to the service or paid features
• That the service will be free from errors or bugs
• That we will maintain the service or any features indefinitely
• That download links for purchased content will remain available forever
• That file formats or export options will remain unchanged
• Compatibility with future software, browsers, or operating systems

We may modify, update, suspend, or discontinue any part of the service (including paid features) at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the service.

For Lifetime Access holders: While we intend to honor lifetime access commitments for the duration of the service, 'lifetime' refers to the lifetime of the product/service, not the lifetime of the purchaser. If we permanently discontinue the service, we will make reasonable efforts to provide notice and, where feasible, allow final downloads of available content.

Service Termination

We may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms of Service
• Fraudulent payment activity or chargebacks
• Abusive behavior or harassment
• Illegal activity or suspected illegal activity
• Requests by law enforcement or government agencies
• Extended periods of inactivity
• Technical or security issues
• Our decision to discontinue the service

Upon termination, your right to use the service will immediately cease. If you have purchased Lifetime Access, termination for cause (violation of Terms) will result in loss of access without refund. If termination is due to our discontinuation of the service, we will make reasonable efforts to provide notice.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution.

Electronic Communications

By using our service or making purchases, you consent to receive electronic communications from us, including:

• Purchase confirmations and receipts
• Download links and access information
• Service announcements and updates
• Responses to your inquiries or support requests

You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

Most disputes can be resolved quickly and amicably through direct communication.

If a dispute cannot be resolved informally within 30 days, you agree that any legal action or proceeding shall be brought exclusively in the courts located in the jurisdiction where the service operators are located, and you consent to the personal jurisdiction of such courts.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in class actions or class-wide arbitration.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction where the service operators are located, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

You agree to submit to the exclusive jurisdiction of the courts located in the jurisdiction where the service operators are located for the resolution of any disputes arising from these Terms or your use of the service.

Severability

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

The invalidity of any provision shall not affect the validity of the remaining provisions, which shall continue to be binding and enforceable.

Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Any waiver must be in writing and signed by us to be effective.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any purchase confirmations or receipts, constitute the entire agreement between you and Image Color Picker regarding your use of the service and any purchases made.

These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter herein.

No modification or amendment to these Terms shall be binding unless in writing and signed by an authorized representative of Image Color Picker.

Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Any attempted assignment in violation of this section shall be null and void.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power outages, internet service provider failures, or third-party service outages.

In the event of such circumstances affecting our ability to deliver purchased content, we will make reasonable efforts to resume service as soon as practicable.

Changes to Terms

We reserve the right to modify these Terms of Service at any time at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page.

For material changes that affect your rights or obligations, we will make reasonable efforts to notify users through the service. Your continued use of the service or any purchases made after changes are posted indicates your acceptance of the updated terms.

If you do not agree to any changes, you must stop using the service. Changes will not apply retroactively to purchases made before the effective date of the changes, except where required by law.
